This Privacy Policy explains how we collect, use, store, share and protect your Personal Data when you use our website, mobile application, technology solutions or any of the products and services offered through our Platform.

Our objective is to be transparent about how your Personal Data is handled and to ensure that it is processed responsibly and in accordance with Applicable Laws. At Lenditt, protecting your Personal Data is an integral part of our business. We process Personal Data only for legitimate business purposes, to provide our services efficiently, to comply with applicable legal and regulatory obligations, to safeguard our Platform against fraud and misuse, and to improve the overall experience of our users.

This Privacy Policy has been prepared in accordance with the provisions of the Digital Personal Data Protection Act, 2023 (“DPDP Act”), the rules framed thereunder (as and when applicable), the Information Technology Act, 2000 and other Applicable Laws, regulations and regulatory directions governing our business.

Where your consent is required under Applicable Law for the processing of your Personal Data, such consent will be obtained through appropriate mechanisms made available by us.

    Lenditt is a technology company that develops and provides digital products and technology solutions for individuals, businesses and financial institutions. Our services include facilitating access to financial products, providing enterprise technology solutions, identity verification and fraud prevention services, insurance facilitation and distribution services and other technology-enabled offerings. Depending on the service you use, Lenditt may act as a technology platform; a Lending Service Provider (LSP); an insurance intermediary; a technology service provider; a referral partner; or a service provider processing Personal Data on behalf of enterprise customers.

    Our role varies depending upon the product or service you access, and so does the manner in which your Personal Data is processed.
     

  2. Definitions

    Unless the context otherwise requires, the following terms shall have the meanings assigned to them below:

    i.  “Applicable Law” means all applicable laws, rules, regulations, notifications, circulars, guidelines and governmental directions in force in India relating  to privacy, data protection or the services provided by Lenditt.

    ii.  “Personal Data” means any data about an individual who is identifiable by or in relation to such data and shall have the meaning assigned to it  under the Digital Personal Data Protection Act, 2023, as amended from time to time.

    iii. “Platform” means the website, mobile application, technology platforms, software applications and other digital interfaces owned, operated or  made available by Lenditt.

    iv. “Service Partner” means any bank, non-banking financial company (NBFC), insurance company, digital gold service provider, identity verification provider, technology provider or any other third party that provides products or services through, in association with, or on behalf of Lenditt.
     

  3. Scope of this Privacy Policy

    This Privacy Policy applies to the Personal Data processed by Lenditt in connection with its website, mobile application, products, services, technology platforms and business operations. It applies whenever you access or use our Platform, create an account, apply for or use any of our services, interact with our technology solutions or enterprise services, communicate with us, participate in our promotional activities, submit information or documents, or otherwise engage with us in any manner. This Privacy Policy applies irrespective of the device or method used to access our Platform or services.
     

  4. Services Covered by this Privacy Policy

    This Privacy Policy applies to all products and services offered by Lenditt, including personal loan facilitation; home loan facilitation; insurance distribution; digital gold and silver referrals; TrueShield services; identity verification and onboarding solutions; fraud prevention solutions; enterprise technology products; our website; our mobile application; and customer support and related services.

    Some services are offered directly by Lenditt, while others are facilitated through authorised Service Partners. Where a product or service is offered by a Service Partner, that partner may process your Personal Data in accordance with its own privacy policy and applicable legal requirements.   5. Personal Data We Collect

    The Personal Data we collect depends on the service you choose to use. This may include name; photograph; gender, date of birth; contact details; address; PAN; Adhaar-related information or masked Aadhaar, where permitted by Applicable Law; and other government-issued identification details; employment and income information; bank account details; documents submitted during onboarding; information relating to the financial product requested by you; communications exchanged with us; and any other information voluntarily provided by you.

    We collect information that enables us to communicate with you regarding your account, applications, transactions, customer support requests and other services. This may include mobile number; Email address; Residential address; Communication preferences. We use this information to provide service-related communications, send one-time passwords (OTPs), respond to your queries, notify you regarding the status of your applications, and, where permitted, provide information regarding our products and services.

    We may automatically collect certain technical information relating to the device through which you access our Platform. Such information may include Device model; Device manufacturer; Operating system and version; Application version; IP address; Device identifiers. This information helps us maintain the stability and security of our Platform, diagnose technical issues, optimise application performance and improve user experience.

    Subject to the permissions granted by you and the settings of your device, we may collect your approximate or precise location information. Where location access is denied, certain services that rely upon location verification may not function as intended.

    As you interact with our Platform, certain information is generated automatically through your use of our services. This information helps us understand how our Platform is used, maintain security, improve system performance and provide a better user experience. Such information may include login history; session information; browsing behaviour within our Platform; pages visited; interaction history. This information may be analysed individually or in an aggregated and anonymised manner to improve our products, optimise user journeys, detect operational issues and strengthen the security of our Platform.

    We may collect your Personal Data directly from you, from your use of our Platform, from publicly available sources, from Service Partners, from enterprise customers using our technology solutions, and from third parties authorised by you or permitted under Applicable Law.
     

  6. Mobile Application Permissions

    Depending on the services requested by you, our mobile application may request access to certain features of your device.

    i.   Camera: Used for document capture, customer onboarding, identity verification and facial verification.​

    ii.  Location: Used to strengthen fraud prevention measures, verify transactions and improve Platform security. 

    iii. Financial SMS: Subject to your consent, we may access only financial SMS messages for income verification, financial assessment and fraud  prevention. We do not access personal conversations or messages exchanged through messaging applications.

    iv. Biometric Information: Facial images, liveness verification and face matching may be processed solely for identity verification and fraud  prevention.

    You may withdraw these permissions through your device settings; however, certain services may become unavailable if essential permissions are denied.
     

  7. How We Use Your Personal Data

    We use your Personal Data to create and manage your account; verify your identity; facilitate the services requested by you; process applications submitted through our Platform; communicate with you regarding your requests; prevent fraud and enhance Platform security; provide customer support; improve our products and services; comply with applicable legal obligations; and protect the rights, safety and security of our users and business.

    We collect and process only such Personal Data as is reasonably necessary for the purposes disclosed in this Privacy Policy and do not process it for purposes that are incompatible with those purposes, unless otherwise permitted under Applicable Law or with your consent. We process your Personal Data with your consent, where required, and for purposes permitted under Applicable Law, including providing the services requested by you, complying with legal obligations, preventing fraud, ensuring Platform security and for other lawful purposes connected with our business.
     

  8. How We Share Your Personal Data

    We may share your Personal Data, only to the extent necessary and in accordance with Applicable Law, with the following categories of recipients:

    i. Our employees and authorised personnel, who require access to your Personal Data for providing our products and services and are bound by  confidentiality obligations.

    ii. Our group companies and affiliates, where necessary for internal administration, customer support, business operations or the provision of our  services.

    iii. Service Partners, including partner banks, NBFCs, insurance companies and digital gold service providers, for facilitating the products or services  requested by you. Such entities process your Personal Data in accordance with their own privacy policies and applicable legal requirements.

    iv. Enterprise customers, where you use technology solutions, fraud prevention services, identity verification services or other enterprise products  provided by Lenditt on behalf of such organisations. Where Lenditt processes Personal Data on behalf of enterprise customers, such customers remain  responsible for determining the purpose of processing and complying with their applicable legal obligations.

    v. Third-party service providers, including identity verification providers, Aadhaar eSign providers, cloud hosting providers, payment service providers,  analytics providers, communication service providers and other technology vendors engaged by us to support our business operations. Such service  providers process Personal Data only on our instructions and are subject to appropriate confidentiality and security obligations.

    vi. Business partners, where necessary to jointly provide, improve or support our products and services or to fulfil our contractual obligations.

    vii. Professional advisors, including auditors, legal advisors, consultants and other professional service providers, where necessary for legal, regulatory  or business purposes.

    viii. Government authorities, regulatory authorities, law enforcement agencies or judicial authorities, where disclosure is required to comply with  Applicable Law, legal process, regulatory requirements, court orders or to establish, exercise or defend legal rights.

    ix. Successors or prospective acquirers, in connection with any merger, acquisition, restructuring, investment, financing or transfer of all or part of our  business or assets, subject to appropriate confidentiality obligations

    We share only such Personal Data as is necessary for the relevant purpose and take appropriate steps to ensure that recipients process your Personal Data in a manner consistent with Applicable Law and appropriate contractual obligations. Where required under Applicable Law, we shall obtain your

    consent before sharing your Personal Data with third parties, unless such sharing is otherwise permitted by law.

  9. Data Storage and Transfers

    At present, Lenditt stores and processes your Personal Data on servers located within India. We do not transfer your Personal Data outside India as part of our ordinary business operations.

    However, if it becomes necessary to transfer or process your Personal Data outside India in connection with our business operations or the services provided by us, such transfer shall be undertaken only in accordance with Applicable Law and subject to appropriate safeguards to protect your Personal Data.
     

  10. Security of Your Personal Data

    We implement reasonable technical, administrative and organisational measures to protect your Personal Data against unauthorised access, use, disclosure, alteration, loss or destruction. These measures include appropriate access controls, encryption where applicable, secure storage and regular monitoring of our systems.

    Access to your Personal Data is restricted to authorised personnel and service providers who require such access to perform their responsibilities and are subject to appropriate confidentiality and security obligations. While we strive to maintain appropriate security safeguards, no method of electronic transmission or storage is completely secure. Accordingly, we cannot guarantee absolute security of your Personal Data, and you are encouraged to take appropriate precautions to protect your account credentials and devices.

    Where Personal Data is shared with Service Partners to facilitate the requested services, such Service Partners shall process the data in accordance with their own privacy policies, applicable laws, and contractual obligations. Lenditt takes reasonable steps to engage Service Partners that implement appropriate privacy and security measures.
     

  11. Our Role Across Different Services

    Lenditt does not perform the same role for every product available through the Platform.

    For certain services, such as our website, mobile application and enterprise technology solutions, Lenditt determines the purpose and means of processing of Personal Data required to provide those services.

    For products such as personal loans, home loans and insurance, Lenditt facilitates your application and shares the Personal Data required for processing with the relevant Service Partner. The approval, underwriting, issuance and servicing of such products are undertaken solely by the respective Service Partner.

    For digital gold and silver services, Lenditt acts solely as a referral and facilitation platform. Once you proceed with the digital gold and silver journey, the collection and processing of your Personal Data are governed by the privacy practices of the service provider.

    Where Lenditt provides technology solutions to businesses or financial institutions, we may process Personal Data on behalf of such organisations in accordance with our contractual obligations. In such cases, the relevant organisation determines the purpose of processing, while Lenditt processes the Personal Data only to the extent necessary to provide the agreed services.
     

  12. Marketing and Communication Services

    We may communicate with you through email, SMS, telephone calls, WhatsApp, in-app notifications, RCS messages or other electronic means regarding your account, the services requested by you, customer support, security alerts, transaction updates, regulatory notices and other information necessary for the provision and administration of our services.

    Where permitted under Applicable Law or with your consent, we may also send you promotional offers, newsletters, educational content, product announcements, campaigns and other marketing communications relating to our products and services. By providing your contact details and, where required, your consent, you agree to receive such communications.

    You may opt out of receiving marketing or promotional communications at any time by using the unsubscribe option provided in the communication or by contacting us at support@lenditt.com. However, your decision to opt out of marketing communications will not affect our ability to send you service-related, transactional or legally required communications that are necessary to administer your account, provide the requested services or comply with Applicable Law.

    Where you contact us through our customer support channels, including email, telephone, chat or other communication channels made available by us, we may process the Personal Data shared by you to respond to your queries, resolve complaints and improve our customer support services.
     

  13. Cookies and Analytics

    Our website may use cookies and similar technologies to improve functionality, remember user preferences, understand website usage and enhance security.   14. Your Responsibility for Account Security

Any activity carried out through your account may be treated as having been authorised by you unless you notify us otherwise.

    Lenditt reserves the right to suspend or restrict access to your account where it reasonably believes that such action is necessary to protect your account, our Platform, other users, or to comply with Applicable Law.
     

  15. Website Analytics, Tracking Technologies and Advertising Partners

    We partner with Microsoft Clarity and Microsoft Advertising to capture how you use and interact with our website through behavioral metrics, heatmaps, and session replay to improve and market our products/services. Website usage data is captured using first and third-party cookies and other tracking technologies to determine the popularity of products/services and online activity. Additionally, we use this information for site optimization, fraud/security purposes, and advertising.   16. Data Retention

    We retain Personal Data only for as long as necessary to provide our services, comply with Applicable Law, fulfil our contractual obligations, resolve disputes, and protect our legal rights.

    As a general practice, Personal Data is retained for up to ten (10) years from the completion of the relevant service or termination of the customer relationship, unless a different retention period is required under Applicable Law, regulatory requirements or contractual commitments.

    Where Lenditt facilitates products or services offered by partner Banks, NBFCs, insurance companies, digital gold service providers, home loan partners or other Service Partners, we retain only such Personal Data as is reasonably necessary for operational, legal and compliance purposes. Personal Data collected on behalf of such Service Partners is processed and shared in accordance with the applicable contractual arrangements and this Privacy Policy.

    Where Lenditt acts as a Lending Service Provider, Personal Data collected on behalf of partner entities is not retained beyond what is necessary for providing our contracted services, complying with Applicable Law, or meeting legitimate business and contractual requirements.
     

  17. Your Rights

    Subject to Applicable Law, you may:

    i. ​  request access to your Personal Data;

    ii.   request correction or updating of inaccurate Personal Data;

    iii.  request deletion of Personal Data where legally permissible;

    iv.  withdraw consent where processing is based on consent;

    v.   nominate another individual to exercise your rights in relation to your Personal Data in accordance with Applicable Law;

    vi.  raise concerns regarding the processing of your Personal Data; and

    vii. exercise any other rights available under Applicable Law.

    Requests relating to products offered by Service Partner may need to be addressed by the relevant Service Partner, although we will provide reasonable assistance where appropriate.
     

  18. Third-Party Websites and Services

    Our Platform may contain links to websites or services operated by third parties. This Privacy Policy applies only to Personal Data processed by Lenditt. We encourage you to review the privacy policies of such third parties before providing your Personal Data. We do not control and are not responsible for the privacy practices of independent third parties once you leave our Platform or are redirected to their systems.

    Our products and services are intended only for individuals who are legally eligible to use them. We do not knowingly collect Personal Data from children.     To the fullest extent permitted under Applicable Law, Lenditt shall not be liable for any unauthorised access, disclosure, loss, alteration or misuse of your Personal Data arising from circumstances beyond our reasonable control, including cyberattacks, system failures, force majeure events or the acts or omissions of independent third parties.

    Where products or services are provided by our Service Partners, Lenditt shall not be responsible for the privacy practices, security measures or processing activities of such Service Partners, which shall be governed by their respective privacy policies and applicable terms.

    Nothing in this Privacy Policy excludes or limits any liability that cannot be excluded or limited under Applicable Law.
     

  22. Limitation of Liability

    While we endeavour to protect your Personal Data and provide our services with reasonable care and diligence, Lenditt shall not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or in connection with your use of the Platform or services, except to the extent such liability cannot be excluded under Applicable Law.

    Nothing in this Privacy Policy excludes or limits any liability that cannot be excluded or limited under Applicable Law.

    Lenditt reserves the right to suspend or terminate your access to the Platform or any of its services where required by Applicable Law, where you breach this Privacy Policy or any applicable terms governing the use of our services, or where we discontinue or modify any product or service.

6. Mobile Application Permissions

Depending on the services requested by you, our mobile application may request access to certain features of your device.

i.  Camera: Used for document capture, customer onboarding, identity verification and facial verification.

ii.  Location: Used to strengthen fraud prevention measures, verify transactions and improve Platform security.

iii. Financial SMS: Subject to your consent, we may access only financial SMS messages for income verification, financial assessment and fraud  prevention. We do not access personal conversations or messages exchanged through messaging applications.

vi. Biometric Information: Facial images, liveness verification and face matching may be processed solely for identity verification and fraud m prevention.

You may withdraw these permissions through your device settings; however, certain services may become unavailable if essential permissions are denied.

7. How We Use Your Personal Data

We use your Personal Data to create and manage your account; verify your identity; facilitate the services requested by you; process applications submitted through our Platform; communicate with you regarding your requests; prevent fraud and enhance Platform security; provide customer support; improve our products and services; comply with applicable legal obligations; and protect the rights, safety and security of our users and business.

We collect and process only such Personal Data as is reasonably necessary for the purposes disclosed in this Privacy Policy and do not process it for purposes that are incompatible with those purposes, unless otherwise permitted under Applicable Law or with your consent. We process your Personal Data with your consent, where required, and for purposes permitted under Applicable Law, including providing the services requested by you, complying with legal obligations, preventing fraud, ensuring Platform security and for other lawful purposes connected with our business.

We may share your Personal Data, only to the extent necessary and in accordance with Applicable Law, with the following categories of recipients

i. Our employees and authorised personnel, who require access to your Personal Data for providing our products and services and are bound by  confidentiality obligations.

iii. Service Partners, including partner banks, NBFCs, insurance companies and digital gold service providers, for facilitating the products or services  requested by you. Such entities process your Personal Data in accordance with their own privacy policies and applicable legal requirements.

iv. Enterprise customers, where you use technology solutions, fraud prevention services, identity verification services or other enterprise products provided by Lenditt on behalf of such organisations. Where Lenditt processes Personal Data on behalf of enterprise customers, such customers remain responsible for determining the purpose of processing and complying with their applicable legal obligations.

v. Third-party service providers, including identity verification providers, Aadhaar eSign providers, cloud hosting providers, payment service providers, analytics providers, communication service providers and other technology vendors engaged by us to support our business operations. Such service providers process Personal Data only on our instructions and are subject to appropriate confidentiality and security obligations.

vi.  Business partners, where necessary to jointly provide, improve or support our products and services or to fulfil our contractual obligations.

vii. Professional advisors, including auditors, legal advisors, consultants and other professional service providers, where necessary for legal,  regulatory or business purposes.

viii. Government authorities, regulatory authorities, law enforcement agencies or judicial authorities, where disclosure is required to comply with  Applicable Law, legal process, regulatory requirements, court orders or to establish, exercise or defend legal rights.

9. Data Storage and Transfers

At present, Lenditt stores and processes your Personal Data on servers located within India. We do not transfer your Personal Data outside India as part of our ordinary business operations.

However, if it becomes necessary to transfer or process your Personal Data outside India in connection with our business operations or the services provided by us, such transfer shall be undertaken only in accordance with Applicable Law and subject to appropriate safeguards to protect your Personal Data.

10. Security of Your Personal Data

We implement reasonable technical, administrative and organisational measures to protect your Personal Data against unauthorised access, use, disclosure, alteration, loss or destruction. These measures include appropriate access controls, encryption where applicable, secure storage and regular monitoring of our systems.

Access to your Personal Data is restricted to authorised personnel and service providers who require such access to perform their responsibilities and are subject to appropriate confidentiality and security obligations. 11. Our Role Across Different Services

Lenditt does not perform the same role for every product available through the Platform.

For certain services, such as our website, mobile application and enterprise technology solutions, Lenditt determines the purpose and means of processing of Personal Data required to provide those services.

For products such as personal loans, home loans and insurance, Lenditt facilitates your application and shares the Personal Data required for processing with the relevant Service Partner. The approval, underwriting, issuance and servicing of such products are undertaken solely by the respective Service Partner.

For digital gold and silver services, Lenditt acts solely as a referral and facilitation platform. Once you proceed with the digital gold and silver journey, the collection and processing of your Personal Data are governed by the privacy practices of the service provider.

Where Lenditt provides technology solutions to businesses or financial institutions, we may process Personal Data on behalf of such organisations in accordance with our contractual obligations. In such cases, the relevant organisation determines the purpose of processing, while Lenditt processes the Personal Data only to the extent necessary to provide the agreed services.

12. Marketing and Communication Services

We may communicate with you through email, SMS, telephone calls, WhatsApp, in-app notifications, RCS messages or other electronic means regarding your account, the services requested by you, customer support, security alerts, transaction updates, regulatory notices and other information necessary for the provision and administration of our services.

Where permitted under Applicable Law or with your consent, we may also send you promotional offers, newsletters, educational content, product announcements, campaigns and other marketing communications relating to our products and services. By providing your contact details and, where required, your consent, you agree to receive such communications.

You may opt out of receiving marketing or promotional communications at any time by using the unsubscribe option provided in the communication or by contacting us at support@lenditt.com. However, your decision to opt out of marketing communications will not affect our ability to send you service-related, transactional or legally required communications that are necessary to administer your account, provide the requested services or comply with Applicable Law.

Where you contact us through our customer support channels, including email, telephone, chat or other communication channels made available by us, we may process the Personal Data shared by you to respond to your queries, resolve complaints and improve our customer support services.

15. Website Analytics, Tracking Technologies and Advertising Partners

We partner with Microsoft Clarity and Microsoft Advertising to capture how you use and interact with our website through behavioral metrics, heatmaps, and session replay to improve and market our products/services. Website usage data is captured using first and third-party cookies and other tracking technologies to determine the popularity of products/services and online activity. Additionally, we use this information for site optimization, fraud/security purposes, and advertising. 16. Data Retention

We retain Personal Data only for as long as necessary to provide our services, comply with Applicable Law, fulfil our contractual obligations, resolve disputes, and protect our legal rights.

As a general practice, Personal Data is retained for up to ten (10) years from the completion of the relevant service or termination of the customer relationship, unless a different retention period is required under Applicable Law, regulatory requirements or contractual commitments.

Where Lenditt facilitates products or services offered by partner Banks, NBFCs, insurance companies, digital gold service providers, home loan partners or other Service Partners, we retain only such Personal Data as is reasonably necessary for operational, legal and compliance purposes. Personal Data collected on behalf of such Service Partners is processed and shared in accordance with the applicable contractual arrangements and this Privacy Policy.

Where Lenditt acts as a Lending Service Provider, Personal Data collected on behalf of partner entities is not retained beyond what is necessary for providing our contracted services, complying with Applicable Law, or meeting legitimate business and contractual requirements.

Subject to Applicable Law, you may:

ii. request correction or updating of inaccurate Personal Data;

iii. request deletion of Personal Data where legally permissible;

iv. withdraw consent where processing is based on consent;

Requests relating to products offered by Service Partner may need to be addressed by the relevant Service Partner, although we will provide reasonable assistance where appropriate.

Our Platform may contain links to websites or services operated by third parties. This Privacy Policy applies only to Personal Data processed by Lenditt. We encourage you to review the privacy policies of such third parties before providing your Personal Data. We do not control and are not responsible for the privacy practices of independent third parties once you leave our Platform or are redirected to their systems.

Where products or services are provided by our Service Partners, Lenditt shall not be responsible for the privacy practices, security measures or processing activities of such Service Partners, which shall be governed by their respective privacy policies and applicable terms.

Nothing in this Privacy Policy excludes or limits any liability that cannot be excluded or limited under Applicable Law.

22. Limitation of Liability

While we endeavour to protect your Personal Data and provide our services with reasonable care and diligence, Lenditt shall not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or in connection with your use of the Platform or services, except to the extent such liability cannot be excluded under Applicable Law.

Nothing in this Privacy Policy excludes or limits any liability that cannot be excluded or limited under Applicable Law.

Lenditt Innovations & Technologies Pvt. Ltd have developed a mobile application called Lenditt (hereafter referred as “Mobile App/Website”) through which you may apply for a short term loan (Loan) to be granted by various non-banking financial company OR Banks (Lender), based on the loan agreement executed between you and LENDER. LENDER has appointed and authorized us to collect, store, authenticate, verify and distribute the Personal Information (defined below) as may be required by LENDER to sanction the Loan. The Personal Information shall be collected through the mobile application form (Mobile Application Form) available on the Application.

We are committed to protect your privacy and have made this Privacy Policy to describe the procedures we adhere to for collecting, using, and disclosing the Personal Information. We recommend you to read this Privacy Policy carefully so that you understand our approach towards the use of your Personal Information.

“LENDER” shall mean non-banking financial company or Banks with whom the Company has tied up for loan sanction, which would sanction, process, and grant the Loan to the Customer(s), through the Platform.

Illustrative Calculation:

  • Loan amount: ₹30,000 with a 28% annual interest rate.

  • Loan Duration: 180 Days

  • Total interest on the personal loan: ₹4,104

  • Processing charge (5% of the loan amount) + Documentation charges (1% of the loan amount) + Online convenience charge = ₹2,000

  • Total Deductions (Processing charge + Documentation charges + Online convenience charge + GST): ₹2,360

  • Net Disbursed Amount: Loan Amount - Total Deductions = ₹27,109

“Customer(s)” or “you” or “End-Users” shall mean any person who accesses, downloads, uses, views the Platform and the Services.

“Loan” shall mean the loan that you may apply for through the Platform and which is sanctioned and granted by LENDER, subject to the applicable terms and conditions of the Loan Agreement.

“Loan Agreement” shall mean the loan agreement to be executed between LENDER and the Customer(s) for granting the Loan whether in physical or electronic form as may be applicable from time to time.

“Online Stores” shall mean Windows Store, Android Google Play, iOS App store, or any other online store or portal where the App will be made available by the Company to the End-Users, from time to time.

“Outstanding Amount(s)” shall mean the Loan, interests, and charges due and payable by you to LENDER, on the respective due date(s).

“Platform” shall mean the App and the Website collectively.

“Services” shall mean the services of granting, sanctioning, lending of short term loans, through the Platform by LENDER.

“Third Party Platforms” shall mean social networking platforms, such as Facebook, LinkedIn and other similar platforms.

“User Data” shall mean any data, information, documents or materials submitted with the Company prior to or during the use of the Services.

“Website” shall mean lenditt.com, managed, and operated by the Company for the provision of Services.

COLLECTION OF USER PERSONAL INFORMATION

When you use our Platform, we collect and store your information which is provided by you from time to time by explicitly seeking permissions from YOU to get the required information. Our primary goal in doing so is to provide you a safe, efficient, smooth and customized experience and Services. This allows us to provide services and features that meets your needs, and to customize our Platform to make your experience safer and easier and to improve the Services provided by us. More importantly, we collect personal information from you that we consider necessary for achieving the aforementioned purpose.

In general, you can browse the Website or App without telling us who you are or revealing any information about yourself. However, to create an account on the Platform, you must provide us with certain basic information required to provide customized services. The information we collect from you, interalia, includes:

  • photograph;

  • mailing address;

  • postal code;

  • phone number;

  • bill details;

  • vehicle details;

  • Permanent Account Number (PAN);

  • Information from credit bureaus and customer service providers;

Wherever possible, we indicate the mandatory and the optional fields. You always have the option to not provide any information by choosing not to use a particular service or feature on the Platform. We also collect user account data which includes email address and user public profile information like name, photo, ASID depending on the platform used by You to log-into the App. This information is required as a part of registration process to access our Service and it is also used to auto-populate relevant fields in the course of the interface of the App. We further collect other identifiable information such as your transactions history on the Platform when you set up a free account with us as further detailed below. While you can browse some sections of our Platform without being a registered member as mentioned above, certain activities (such as availing of loans from the third party lenders on the Platform) require registration and for you to provide the above details. The Platform will clearly display the personal information it is collecting from you, and you have the option to not provide such personal information. However, this will limit the services provided to you on the Platform.

Our App also collects mobile number for verification to check the active SIM status on the device, uniquely identify you and prevent frauds and UN-authorised access.

As part of the Services, you authorize us to import your details and Personal Information dispersed over Third Party Platforms. Third Party Platforms are social networking platforms, such as Facebook, LinkedIn and other similar platforms which will be used based on our proprietary AI algorithm.

All transactions undertaken on your behalf by the Company will be on the basis of your express instructions/consent and will be strictly on a non-discretionary basis. Once you verify and upload the User Data and/or other documents and details in the Mobile Application Form, the Company shall process the same. Upon the completion of the document verification by the Company, the Loan may be sanctioned by LENDER to you, subject to fitting eligibility criteria and other conditions set forth by LENDER for sanctioning the Loan. Thereafter, you are required to fill and upload the ECS/NACH mandate form/Cheque or any other document as may be required by LENDER. LENDER shall disburse the Loan subject to the terms and conditions of the Loan Agreement.

You can also request to remove content from our servers based on applicable law or by writing to our Grievance team.

The sanctioned Loan shall be disbursed as per the mode provided in the Mobile Application Form. You are required to repay the Outstanding Amount(s) to LENDER, on the respective due date(s) mentioned in the Mobile Application Form.

You understand and acknowledge that the Company reserves the right to track your location (Track) during the provision of the Services, and also in the event that you stop, cease, discontinue to use or avail the Services, through the deletion or uninstallation of the Mobile App or otherwise, till the event that your obligations to pay the Outstanding Amount(s) to LENDER, exist. Deletion, uninstallation, and/or discontinuation of our Services, shall not release you from the responsibility, obligation and liability to repay the Outstanding Amount(s).

You understand and acknowledge that you shall be solely responsible for all the activities that occur under your User Account while availing the Services. You undertake that the Company shall not be responsible and liable for any claims, damages, disputes arising out of use or misuse of the Services. By usage of the Services, you shall be solely responsible for maintaining the confidentiality of the User Account and for all other related activities under your User Account. The Company reserves the right to accept or reject your registration for the Services without obligation of explanation.

COLLECTION OF DEVICE LOCATION AND DEVICE INFORMATION

We collect & store location information from your device to reduce the risk associated with your account based on your area, city & state. Based on your location, App evaluates serviceability criteria and also determines your income requirements to get your loan application processed. App can also use your location via background services to understand your location stability matrix.

We collect information about your device to provide automatic updates and additional security so that your account is not used in other people’s devices. In addition, the information provides us valuable feedback on your identity as a device holder as well as your device behavior, thereby allowing us to improve our products interaction, quality of services and provide an enhanced customized user experience to you.

CAMERA

We require camera access to scan and capture the required KYC documents thereby allowing us to auto-fill relevant fields.

As a part of facilitation of the KYC journey, we require access to your camera to enable you to initiate your KYC process. This permission allows us or our authorized agents to perform your KYC while also taking screenshots of your original Officially Verified Documents that you present during your KYC journey. KYC enables you to complete your KYC digitally, smoothly and efficiently. Your KYC information shall be recorded and retained for regulatory purpose along with the screenshots of original Official Verified Documents.

STORAGE

We require storage permission so that your KYC and other relevant documents can be securely downloaded and saved on your phone. You can then easily upload the correct KYC related documents for faster loan application details filling and disbursal process. This ensures that you are provided with a seamless experience while using the application.

COLLECTION OF OTHER NON-PERSONAL INFORMATION

We automatically track certain information about you based upon your behavior on our Platform. We use this information to do internal research on our users’ demographics, interests, and behavior to better understand, protect and serve our users and improve our services. This information is compiled and analyzed on an aggregated basis. We also collect your Internet Protocol (IP) address and the URL used by you to connect your computer to the internet, etc. This information may include the URL that you just came from (whether this URL is on our Website or not), which URL you next go to (whether this URL is on our Website or not), your computer browser information, and your IP address.

Conduct data analysis in order to improve the Services / Products provided to the User;

DEVICE INFORMATION – COLLECTIONS & USAGE

We use the information provided by You in the following ways:

Monitor, improve and administer our Mobile application experience;

Provide our service i.e. perform credit profiling for the purpose of facilitating loans to You.

Send communications notifications, information regarding the products or services requested by You Perform data analysis in order to improve the Services / Products provided to the User;

Conduct KYC for our third party lending partners based on the information shared by the User;

Use the information in other ways permitted by law to enable You to take financial services from our lending partners.

We will use and retain Your information for such periods as necessary to provide you the Services on our Applications, to comply with our legal obligations, to resolve disputes, and enforce our agreements.

GOVERNING STATUTE

You have choices regarding the information we collect and how it is used:

Device-level settings: Your device may have controls that determine what information we collect. For example, you can modify permissions on your Android device for access to Camera or Audio permissions.
Delete your entire App account.

You can also request to remove content from our servers based on applicable law or by writing to our Grievance team.

You also have control of turning off the location & contact permissions based on your preference.

This Privacy Policy is governed by and is compliant with the Information Technology( Reasonable Security Practices and Procedures and Sensitive Personal Data or Information)Rules 2011, which is designed to protect Personal Information of the End-User(s) of the Services; and other applicable rules and regulations related to privacy.

Service Providers : We may share your Personal Information with the service providers, including LENDER, who are working with us in connection with the operation of the Services or the Platform, so long as such service providers are subject to confidentiality restrictions consistent with this Privacy Policy.

Joint Marketing Measures : Where permitted by law, we may share your Personal Information with joint marketers with whom we have a marketing arrangement, we would require all such joint marketers to have written contracts with us that specify the appropriate use of your Personal Information, require them to safeguard your Personal Information, and prohibit them from making unauthorized or unlawful use of your Personal Information.

Persons Who Acquire Our Assets or Business : If we sell or transfer any of our business or assets, certain Personal Information may be a part of that sale or transfer. In the event of such a sale or transfer, we will notify you.

Notwithstanding anything mentioned hereinabove, the Company shall not be responsible for the actions or omissions of the service providers or parties with whom the Personal Information is shared, nor shall the Company be responsible and/or liable for any additional information you may choose to provide directly to any service provider or any third party.

DATA RETENTION

We will retain your Personal Information for as long as your registration with us is valid and the Outstanding Amount(s) is due and payable to LENDER. We may also retain and use your Personal Information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. Subject to this section, we will try to delete your Personal Information upon reasonable written request for the same. Please note, however, that there might be delay’s in deleting Personal Information from our servers and backed-up versions might exist even after deletion.

SECURITY

We value your Personal Information, and protect it on the Platform against loss, misuse or alteration by taking extensive security measures. In order to protect your Personal Information, we have implemented adequate technology and will update these measures as new technology becomes available, as appropriate. All Personal Information is securely stored on a secure cloud setup and all communication happens via bank-grade secure SSL communication channels. The Personal Information is stored on Cloud platforms and they may change based on our business requirements. Although we provide appropriate firewalls and protections, we cannot warrant the security of any Personal Information transmitted as our systems are not hack proof. Data filching due to unauthorized hacking, virus attacks, technical issues is possible and we take no liabilities or responsibilities for it.

You are responsible for all actions that take place under your User Account. If you choose to share your User Account details and password or any Personal Information with third parties, you are solely responsible for the same. If you lose control of your User Account, you may lose substantial control over your Personal Information and may be subject to legally binding actions.

We aim to protect from unauthorized access, alteration, disclosure or destruction of information we hold, including:

We use encryption to keep your data private while in transit;

We offer security feature like an OTP verification to help you protect your account;

We review our information collection, storage, and processing practices, including physical security measures, to prevent unauthorized access to our systems;

We ensure that Aadhaar number is not disclosed in any manner.

We also comply with certain legal frameworks relating to the transfer of data as mentioned and required under the Information Technology Act, 2000 and rules made thereunder.

When we receive formal written complaints, we respond by contacting the person who made the complaint. ACCESSING AND MODIFYING PERSONAL INFORMATION

In case you need to access, review, and/or make changes to the Personal Information, you shall have to login to your User Account and change the requisite details. You shall keep your Personal Information updated to help us better serve you.

We may provide you with certain ancillary services such as chat rooms, blogs and reviews for the Services. Subject to any applicable laws, any communication shared by you via the Platform or through the blogs, reviews or otherwise to us (including without limitation contents, images, audio, financial information, feedback etc. collectively Feedback) is on a non-confidential basis, and we are under no obligation to refrain from reproducing, publishing or otherwise using it in any way or for any purpose. You shall be responsible for the content and information contained in any Feedback shared by you through the Platform or otherwise to us, including without limitation for its truthfulness and accuracy. Sharing your Feedback with us, constitutes an assignment to us of all worldwide rights, titles and interests in all copyrights and other intellectual property rights in the Feedback and you authorize us to use the Feedback for any purpose, which we may deem fit.

COMMUNICATIONS FROM THE PLATFORM

Special Offers and Updates: We may send you information on products, services, special deals, and a newsletter of the Company. Out of respect for your privacy, we present you with the option of not receiving these types of communications. You may unsubscribe via the unsubscribe mechanism provided in each such communication or by emailing us at info@lenditt.com

Service Announcements: On certain occasions or under law, we are required to send out Service or Platform related announcements. We respect your privacy, however you may not opt-out of these communications. These communications would not be promotional in nature.

Customer Service: We communicate with Customer(s) on a regular basis to provide requested services and in regards to issues relating to their User Account, we reply via email or phone, based on Customer(s) requirements and convenience.

INDEMNIFICATION

You agree to indemnify us, our subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees and hold us harmless from and against any claims and demand, including reasonable attorneys fees, made by any third party arising out of or relating to: (i) Personal Information and contents that you submit or share through the Platform; (ii) your violation of this Privacy Policy, (iii) or your violation of rights of another Customer(s).

LIMITATIONS OF LIABILITY

You expressly understand and agree that the Company shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, information, details or other intangible losses (even if the Company has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the Services; (ii) unauthorized access to or alteration of your Personal Information.

TERMINATION

The Company reserves its rights to terminate these Terms in the event:

you breach any provision of these Terms;
the Company is required to do so under law; or
the Company chooses to discontinue the Services being offered or discontinue to operate the Platform;
the license granted to use the App expires;
of non-payment of Outstanding Amount(s).

The Company reserves its right to Track you, even when you have uninstalled the App or even after termination of these Terms, until all your obligations, including but not limited to payment of the Outstanding Amount(s) is in subsistence.

Upon termination of these Terms, the rights and licenses granted to you under these Terms shall cease to exist, and you must forthwith stop using the Platform and the Services and repay the Outstanding Amount(s). Notwithstanding anything contained in these Terms or otherwise, the termination of these Terms for any reason whatsoever, shall not affect your obligations, including but not limited to repayment of the Outstanding Amount(s).

GOVERNING LAWS AND DUTIES

You expressly understand and agree that the Company, including its directors, officers, employees, representatives or the service provider, shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if the Company has been advised of the possibility of such damages), resulting from; (a) use or the inability to avail the Services (b) inability to use the Platform (c) failure or delay in providing the Services or access to the Platform (d) any performance or non-performance by the Company (e) any damages to or viruses that may infect your electronic devices or other property as the result of your access to the Platform or your downloading of any content from the Platform and (f) server failure or otherwise or in any way relating to the Services.

FORCE MAJEURE

This Agreement shall be construed and governed by the laws of India and courts of law at Ahmedabad, Gujarat, India and this shall have exclusive jurisdiction over such disputes without regard to principles of conflict of laws.

CHANGES TO THIS POLICY

We may update this Privacy Policy without notice to you. You are encouraged to check this Privacy Policy on a regular basis to be aware of the changes made to it. Continued use of the Services and access to the Platform shall be deemed to be your acceptance of this Privacy Policy.
